Sale or Transport Narcotic / drugs - California Health & Safety Code 11352

Anyone who transports, traffics, sells, administers, distributes, furnishes, gives away or imports into the state of California, any controlled substance, commonly known as narcotics or drugs specified in the California Health & Safety Code, such as Opiates, Opium derivatives, Depressants, among others; shall be punished by imprisonment for 3, 4, or 5 years depending on the circumstances of the case. 

A person can also face charges for this crime for aiding and abetting the commission of, or conspiring to commit, or acting as an accessory to, of any of the acts mentioned above, this also includes  if the person attempts to perform those acts or even offers to another person.

Additionally, any person who transports for sale any of the controlled substances by the  California Health & Safety Code within the state of California from one county to another noncontiguous county shall be punished by imprisonment for 3, 6, or 9 years.

Manufacture of Controlled Substances or drugs - California Health & Safety Code 11379.6

Every individual who either directly or indirectly by chemical extraction or  separately by means of chemical synthesis produces, manufactures, converts, derives, compounds, processes, or prepares in any way, any controlled substance or drug specified in Section 11054, 11055, 11056, 11057, or 11058 shall be punished by jail time for 3, 5, or 7 years and by a fine not exceeding $50,000

Such penalties vary depending on the circumstances of the case. For instance, if a person under 16 years of age resided in a structure in which the manufacture involving methamphetamine occurred shall be considered a factor in aggravation by the sentencing court. Or if a person who offers to perform one of the acts mentioned in this section, shall be punished by imprisonment for 3, 4, or 5 years.

Possession of controlled substance or drugs - Health & Safety Code 11377 - AB2603

Except as authorized by law, several sections of the California Health & Safety Code, and the  prescription of a physician, dentist, podiatrist, or veterinarian, licensed to practice in this state of California, every person who possesses any controlled substance such as methamphetamine and which is not a narcotic drug, shall be charged with misdemeanor punished by imprisonment in a county jail up to 1 year can include a fine of up to $1,000.
